Complaints that can be lodged by the strata unit owner to the COB include:
- Not satisfied with sum determined for the maintenance charges or contribution to Sinking Fund [S12(7), SMA]
- The maintenance and management of the building and common property by the JMC is not satisfactory [S86(1)(b), SMA]
- The assigned share units contribution is not satisfactory [R9 (4B), SMR]
- That the AGM was not conducted in accordance with the SMA
Besides strata unit owners, any other party such as the Developer, JMC managing agent or others can also lodge complaints to the COB on matters that are relevant to the maintenance and management of the strata property.
The COB plays an active role attending to complaints and resolving disputes between parties involved in the maintenance and management of the strata property before seeking help from the Strata Management Tribunal (SMT). However, not all disputes can be referred to SMT; only disputes listed in the Fourth Schedule (Part 1) of SMA can be heard.
